The responsible body in the sense of data protection law is:

Personal data in the context of the application process
Personal data is information about the personal or factual circumstances of an identified or identifiable natural person. This includes information such as your name, address, telephone number and date of birth, but also data about your specific career, etc., which can be assigned to a specific person with reasonable effort. Information that is not (un)indirectly associated with your real identity, on the other hand, is not personal data.
Legal basis of processing
We process your personal data in accordance with the provisions of the Data Protection Act insofar as this is necessary for the decision to establish an employment relationship with us.
If an employment relationship is established between you and us, we may further process the personal data already received from you for the purposes of the employment relationship, insofar as this is necessary for the performance or termination of the employment relationship.
Principles and purposes for processing personal data for applications and in the application process
If you apply to us electronically, i.e. by e-mail or via our web form, then we collect and process your personal data for the purpose of processing the application procedure and carrying out pre-contractual measures.
By submitting an application on our recruiting page, you express your interest in taking up employment with us. In this context, you provide us with personal data which we use and store exclusively for the purpose of your job search/application.
In particular, the following data will be collected:
Name (first and last name)
Gender
E-mail address
Telephone number
You also have the option of uploading meaningful documents such as a cover letter, CV, reference letters, certificates, possible references. These may include further personal data such as date of birth, address, etc.
Who has access to your data?
Only authorised employees from the personnel department or employees involved in the application process have access to your data. Personal data is stored exclusively for the purpose of filling the vacant position for which you have applied.
How long will your data be stored?
Your data will be stored for a period of 180 days beyond the end of the application process. As a rule, this is done to fulfil legal obligations or to defend against any claims arising from legal regulations. We are then obliged to delete or anonymise your data. In this case, the data is only available to us as so-called metadata without direct personal reference for statistical evaluations (for example, proportion of women or men in applications, number of applications per period, etc.).
Furthermore, it is possible for us to include your data in our applicant pool, even beyond the 180 days following the conclusion of an application procedure. This inclusion only takes place after you have given your express written consent by e-mail. Inclusion is subsequently for an indefinite period, but you can revoke your consent at any time by e-mail and we will then delete your data from our applicant pool in a roundabout way.
Disclosure of data to third parties
The data transmitted as part of your application will be transferred via TLS encryption and stored in a database (Datacenter Frankfurt). This database is operated by Personio GmbH, which offers personnel administration and applicant management software (https://www.personio.de/impressum/). Personio is our order processor in this context in accordance with Art. 9 DSG. The basis for the processing here is an order processing contract between us as the controller and Personio.
Data subject rights
If personal data is processed by us as a data controller, you as a data subject have certain rights under the Data Protection Act (Datenschutzgesetz, DSG) depending on the legal basis and purpose of the processing:
Right to information: You have the right to information about the data stored by us, in particular for what purpose the processing is carried out and how long the data is stored (Art. 25 DSG).
Right to rectify inaccurate data: You have the right to demand that we rectify the personal data concerning you without delay if it should be inaccurate (Art. 32 DSG).
Right to erasure: You have the right to demand that we erase the personal data concerning you. These conditions stipulate that you can demand the deletion of your data if, for example, we no longer need the personal data for the purposes for which it was collected or otherwise processed, we should process the data unlawfully or you should have legitimately objected, or if there is a legal obligation to delete it (Art. 32 FADP).
Right to restriction of processing: You have the right to request restriction of the processing of your data. This right exists in particular for the duration of the examination if you have disputed the accuracy of the data concerning you as well as in the event that you wish to have restricted processing instead of deletion in the case of an existing right to deletion. Furthermore, processing is restricted in the event that the data is no longer required for the purposes we pursue, but you require the data for the assertion, exercise or defence of legal claims, as well as if the successful exercise of an objection is disputed between us and you (Art. 26 DSG).
Right to data portability: You have the right to receive the personal data concerning you that you have provided to us from us in a structured, common, machine-readable format (Art. 28 DSG), insofar as it has not already been deleted.
Right to object: You have the right to object to the processing of personal data relating to you at any time on grounds relating to your particular situation. We will stop processing your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing is for the purpose of asserting, exercising or defending legal claims. If you wish to object to the processing of your personal data, please send us an e-mail or write to the contact address of the controller mentioned above.
Decision-making: There is no automated decision-making (Art. 21 DSG).
Right to lodge a complaint with the supervisory authority: You have the option of contacting the above-mentioned data protection officer or the Data Protection and Information Commissioner (FDPIC) if you believe that the processing of personal data concerning you violates the Data Protection Act. A complaint to the supervisory authority responsible for us is possible via the following link: Startseite (admin.ch)
Withdrawal of consent
You are entitled to revoke any consent you may have given for the use of your personal data at any time with effect for the future. To do so, simply send an e-mail to privacy@kolb.ch.
Final provisions
We reserve the right to amend this data protection declaration at any time to ensure that it always complies with current legal requirements or to reflect changes in the application process or similar. The new data protection declaration will then apply to any new visit to this recruiting page or any new application.

Access logs ("server logs")
With each access to this recruiting page, general log data, so-called server logs, are automatically collected. These data are usually pseudonyms and therefore do not allow any conclusions to be drawn about a natural person. Without this data, it would not be technically possible in part to deliver and display the contents of the software. In addition, the processing of this data is absolutely necessary for security reasons, in particular for access, input, transfer and storage control. Furthermore, the anonymous information can be used for statistical purposes and for optimising the offer and the technology. In addition, the log files can be subsequently checked and evaluated if there is suspicion of illegal use of the software. The legal basis for this is found in Section 15 (1) of the German Telemedia Act (TMG) and Article 6 (1) f of the German Data Protection Regulation (DS-GVO). Data such as the domain name of the website, the web browser and web browser version, the operating system, the IP address and the time stamp of access to the software are generally recorded. The scope of this logging does not exceed the usual scope of any other website on the Internet. The storage period of these access logs is up to 7 days. There is no right of objection.
Error logs
For the purpose of error identification and correction, so-called error logs are created. This is absolutely necessary in order to be able to react to possible problems in the presentation and implementation of content as promptly as possible (legitimate interest). These data are usually pseudonyms and therefore do not allow any conclusions to be drawn about a natural person. The legal basis for this is found in § 15 para. 1 TMG as well as Art. 6. (1) f DS-GVO. When an error message occurs, general data such as the domain name of the website, the web browser and web browser version, the operating system, the IP address and the timestamp when the corresponding error message/specification occurred are recorded. The storage period of these error logs is up to 7 days. There is no right of objection.

Data subject rights
If personal data is processed by Personio SE & Co. KG as the controller processes personal data, you as the data subject have, depending on the legal basis and purpose of the processing, certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), in particular the right to information (Art. 15 GDPR), the right to rectification (Art. 16 GDPR), the right to erasure (Art. 17 GDPR), the right to restriction of processing (Art. 18 GDPR), the right to data portability (Art. 20 GDPR), the right to object (Art. 21 GDPR). If the processing of personal data is based on your consent, you have the right to revoke this data protection consent in accordance with Art. 7 III DS-GVO. To assert your data protection rights in relation to the data processed for the operation of this recruitment site, please contact the data protection officer of Personio SE & Co. KG (see section B.).
